Terms of service
1. About Us
Welcome to Making It Personal! These Terms of Service explain the terms that apply when you visit our website or purchase products from us.
Throughout these terms, “we”, “us” and “our” refer to Making It Personal. “You” and “your” refer to anyone using our website or purchasing from us.
By using our website or placing an order, you agree to these terms.
2. Our Products
We create and sell a range of personalised gifts, handmade products, stationery and items for celebrations and special occasions.
Many of our products are made to order and customised using the information you provide.
We aim to display our products as accurately as possible. However, slight variations in colour, finish, materials and appearance may occur due to screen settings, printing processes and the handmade nature of certain products.
Where appropriate, product descriptions will explain the available options, sizes, materials and personalisation requirements.
3. Personalisation & Customer Responsibility
When placing an order for a personalised product, you are responsible for checking that all information supplied is correct.
This includes names, dates, spelling, wording, logos, colours and any other customisation details.
Please check your order carefully before completing your purchase. We cannot guarantee that changes can be made once production has started.
If we create an item using the details you supplied correctly, we are not responsible for errors contained in those details. This does not affect your statutory rights where a product is faulty or does not match the agreed description.
If you provide photographs, logos or other artwork, you must have the necessary permission or rights to use them.
4. Orders & Acceptance
When you place an order through our website, you are submitting a request to purchase the selected products.
You will receive an order confirmation once your order has been submitted. We will communicate with you if any further information is needed.
We reserve the right to decline or cancel an order where there is a genuine reason, such as a product being unavailable, an obvious pricing error or an inability to fulfil the order. If payment has already been taken for an order we cancel, we will arrange an appropriate refund.
We will not unreasonably refuse an order.
5. Prices & Payments
All prices will be displayed on the relevant product pages and at checkout.
Any applicable delivery charges will be shown before you complete your purchase.
Payment must be made using the payment methods available on our website. Orders will not normally enter production until payment has been received, unless otherwise agreed.
We reserve the right to update product prices, but any changes will not affect an order we have already accepted.
If an obvious pricing error occurs, we will contact you to explain the situation before proceeding.
6. Handmade & Made-to-Order Products
Many of our products are made individually or personalised specifically for each customer.
For this reason, slight differences between individual items may occur. These variations are part of the nature of handmade production and do not automatically mean an item is faulty.
We take care to ensure our products meet the descriptions and specifications advertised. Your statutory rights remain unaffected if a product is faulty, not as described or otherwise fails to meet the requirements of applicable consumer law.
7. Shipping & Delivery
We currently deliver to addresses within the United Kingdom only.
Available delivery options, costs and estimated processing or delivery times will be provided on the relevant product page or at checkout, as applicable.
We make every reasonable effort to prepare and dispatch orders within the stated timeframe. However, delays can occasionally occur due to seasonal demand, postal disruptions or circumstances outside our control.
If you have a concern about your delivery, please contact us with your order number.
For further information, please refer to our separate Shipping & Delivery Policy.
8. Cancellations, Returns & Refunds
Our returns and refunds arrangements are explained in our separate Returns & Refunds Policy.
Some personalised or custom-made goods are exempt from the usual statutory right to cancel simply because you have changed your mind. This exemption does not remove your rights if an item is faulty, not as described or otherwise fails to meet applicable legal requirements.
Where a right to cancel or obtain a refund applies, we will honour your rights under the relevant consumer protection legislation.
9. Intellectual Property
Unless otherwise stated, the content on our website, including our original designs, photographs, graphics, branding, product descriptions and written content, belongs to Making It Personal or is used with permission.
You may not reproduce, copy, distribute or commercially use our original content or designs without obtaining the appropriate permission.
If you provide artwork, logos or images for personalisation, you confirm that you have the necessary rights or authorisation for us to use them to fulfil your order.
We reserve the right to decline requests that we reasonably believe infringe another person’s intellectual property rights.
10. Website Use
You agree to use our website lawfully and not to misuse it, interfere with its operation or attempt to gain unauthorised access to any part of the website or its systems.
We aim to keep our website information accurate and available, but we cannot guarantee that the website will always operate without interruption or error.
We may update website content, product listings or features when necessary.
11. Limitation of Liability
Nothing in these terms excludes or limits any liability that cannot legally be excluded or limited.
In particular, these terms do not affect your statutory consumer rights or our legal responsibilities regarding faulty goods, misleading descriptions or other obligations under applicable law.
We will not be responsible for losses that could not reasonably have been anticipated when the contract was formed, except where the law requires otherwise.
12. Privacy & Personal Information
We use personal information to process orders, communicate with customers and provide our services in accordance with our Privacy Policy and applicable data protection law.
Please refer to our separate Privacy Policy for information about how we collect, use, store and protect your personal data.
13. Changes to These Terms
We may update these terms from time to time to reflect changes to our business, website or legal obligations.
The latest version will be published on our website with its updated date. Any changes will not retrospectively alter the terms of an order already accepted unless required by law or agreed with you.
14. Governing Law
These terms are governed by the laws of England and Wales, subject to any mandatory consumer protection rights that apply to you.
If a dispute arises, we encourage you to contact us first so that we can try to resolve the matter fairly and amicably.
